Murray Chevrolet Lethbridge SMS Terms of Service

1. Acceptance of Terms
By opting in to receive SMS (text) messages from Murray Chevrolet Lethbridge (the “Dealership,” “we,” “us,” “our”), you (“the user,” “you,” “your”) agree to these Terms of Service (“TOS”). If you do not agree, please do not opt in or promptly unsubscribe.
2. Program Description
We offer SMS messaging to provide:
- Service updates, appointment reminders, and transactional notifications (“Service Messages”)
- Marketing and promotional communications, such as special offers, vehicle upgrades, and dealership events (“Marketing Messages”)
You can choose to receive one or both types of SMS messages by selecting the corresponding consent checkbox(es) on our opt-in form.
3. Eligibility
- You must be at least 18 years old or have reached the age of majority in your jurisdiction of residence to opt in.
- By signing up, you represent and warrant that you are the authorized user of the mobile device and phone number provided.
4. Message Frequency and Fees
- Message Frequency: Message frequency may vary based on your preferences and engagement with the Dealership.
You may receive up to 4 messages per month, but this can change depending on the nature of your interactions.
- Fees: Standard message and data rates may apply, as determined by your mobile service carrier. You are
responsible for any fees charged by your carrier.
5. Opt-In and Consent
- Separate Consents: If you choose to receive Service Messages and Marketing Messages, you must affirmatively
check each corresponding box on our opt-in form.
- No Pre-Selected Boxes: Boxes for SMS messaging are never pre-selected, ensuring that your consent is explicit.
- Recordkeeping: We maintain records of your consent (time, date, and method of consent).
6. Opt-Out and Help Instructions
- Stop Receiving SMS: You can unsubscribe at any time by texting “STOP” in reply to any SMS from us.
After texting “STOP,” we may send you a final confirmation message to confirm your opt-out request.
- Help: For assistance, text “HELP” to the number you received messages from, or call our support team at 403-328-1101.
7. Privacy and Data Use
We value your privacy. Please review our Privacy Policy for information on how we collect, use, store, and disclose your personal information. By opting in, you consent to the collection and use of your personal information (including phone number) for the purpose of sending you Service Messages, Marketing Messages, or both (depending on your selections).
8. User Responsibilities
- Accurate Information: You agree to provide accurate contact information. You will promptly notify us
if your phone number changes or is reassigned.
- Authorized Device Use: You confirm you are the authorized user of the mobile device and phone number
provided, and you are permitted to incur any related data or message charges.
9. Disclaimers
- Availability: We do not guarantee uninterrupted or error-free transmission of SMS messages.
Factors outside our control (e.g., cellular network issues) may cause delays or message failures.
- No Warranty: To the maximum extent permitted by law, SMS messages are provided “as is” and “as available,”
without warranties of any kind, either express or implied.
10. Limitation of Liability
Under no circumstances will Murray Chevrolet Lethbridge, its affiliates, employees, or agents be liable for direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of the SMS program. If any jurisdiction does not allow limitations of liability in certain cases, the above limitations may not apply to you to the extent prohibited by law.
11. Indemnification
You agree to indemnify and hold harmless Murray Chevrolet Lethbridge, its affiliates, employees, and agents from any claims, damages, losses, or liabilities, including attorneys’ fees, arising out of your violation of these TOS or misuse of the SMS program.
12. Modification or Termination
- Modification of Terms: We may modify these TOS at any time. When we do, we will post the updated terms
on our website with a new “Effective Date.” Your continued participation in the SMS program constitutes acceptance of any changes.
- Program Termination: We reserve the right to suspend or discontinue the SMS program at any time,
for any reason, with or without notice.
13. Governing Law
These TOS are governed by and construed in accordance with the laws of Alberta, Canada, without regard to conflict-of-law principles. Any disputes must be resolved exclusively in the courts located in Lethbridge, Alberta.
